Nassau, New York. MONIER LAW Personal Injury Lawyer, PHIL MONIER, obtained a $1.2 Million Dollar settlement prior to trial in the Supreme Court of the State of New York, Nassau County, on behalf of his client, a 51 year old driver involved in the accident.
The lawsuit was brought to obtain compensation for a car wreck victim who was seriously injured when a car dealer’s employee crashed into a third vehicle, causing a chain reaction ending in the “T-Boning” of her car. An accident referred to as a T-Bone, occurs when one vehicle strikes another directly in the side, basically forming a right angle or “T” formation. The impact from the accident caused her to suffer injuries, including to her neck and lower back. As a result of these traumatic injuries she was left hemi-paralyzed immediately following the accident and had to undergo a surgical procedure.
The herniated disc material in her lower back had to be surgically reduced. The trauma from the impact to her lower back caused temporary paralysis and later residual and debilitating pain. The crash caused the jell-like interior of the discs located between the vertebrae in her spine to rupture through the hard cartilage exterior and press against nerves, that allow movement and cause pain. This serious injury required surgical intervention especially since she lost function and motion on the left side of her body.
The lawyers for the owner and driver of the responsible vehicle were prepared to argue that our client’s injuries were, at least in part, pre-existing and that following the surgery she made a full and lasting recovery. They were further prepared to argue that she was already unemployed and disabled on the date of the accident as a result of a different, but contributing medical condition; and that although she was paralyzed immediately following the accident, that condition only last a week or so.
Following the settlement, PHIL MONIER commented that, “We were prepared to call medical and economic experts to demonstrate to the jury the extent of this lovely woman’s injuries and the effect that these injuries have had, and will continue to have, on her life. When an accident happens as the result of someone’s negligence, or failure to use reasonable care, the injured party deserves to be fully compensated for not only what that person has gone through since the date of the accident, but also for what the person will go through in the future, for the rest of that person’s life. The proceeds from this settlement will help our client deal with her continuing pain and functional difficulties.”
