$1,000,000 SETTLEMENT FOR CAR CRASH VICTIM

crashBrooklyn, New York.  MONIER LAW Personal Injury Trial Attorney, Phil Monier, obtained an $1,000,000 settlement as compensation for serious injuries suffered by a 59 year-old Brooklyn driver involved in an accident with an Access-a-Ride vehicle.  The lawsuit was brought against the driver and the registered owner of the Access-a-Ride vehicle in the Supreme Court of the State of New York, Kings County.   A jury was selected to hear and decide the issues in the lawsuit, prior to the  settlement being reached.  “The Access-a-Ride vehicle was pulling out of a parking spot and hit our client’s car while he was making a turn with such force that it also damaged five other cars that were parked on the street,” explained Phil Monier, “we were prepared to prove that the driver of the Access-a-Ride vehicle failed to use reasonable care, failed to use his senses to observe what was there, and failed to safely pull out of the parking spot causing  the Flatbush Avenue accident.”   The injured driver, a Brooklyn pastor,  suffered injuries to his back, and other injuries, as a result of the accident.  Herniated discs occur as the result of a trauma, such as a car accident.  Trauma causes the jell-like interior of the discs located between pairs of vertebrae in the spine to rupture through the hard cartilage exterior and press against the nerves causing pain.  This serious injury to the soft tissue is permanent, unlike a bone fracture which heals usually without surgery.  The driver of the Access-a-Ride vehicle claimed that both drivers were responsible for the accident and his doctors were prepared to testify that none of the permanent neurological injuries were causally related to the accident.   “We were prepared to have our medical experts testify and to ask the jury to find the driver and his employer fully responsible and award a sum that would fairly and justly  compensate him for his past and future damages.  The offer was accepted as an amicable resolution of the issues presented in this case and will assist our client with his future needs.”
